Our Solicitors focus on early recovery of debt and it is important from the outset that the most effective method in debt recovery is used both in terms of costs and recovery for our clients. Each instruction is studied carefully before determining the best way forward for our clients in securing the debt. This will be dependent upon the size of the debt, the history around the debt, i.e. is there potentially a valid dispute, and details of the debtor. We negotiate payment plans on behalf of clients who want to offer this service to their clients. This is a lower cost alternative to legal proceedings and one where we make it very clear to the debtor that should they default in any payments then proceedings will follow immediately.

Our Process

We offer advice and assistance to our clients at every stage of the debt recovery process – from the initial letter before action, during legal proceedings and through to the enforcement of a judgement.

For unsecured debts, proceedings are instigated through the Small Claims Court for debts up to £3,000. For debts between £3,000 and £30,000 proceedings are issued by way of Civil Bill. For a debt over £30,000 proceedings are brought in the High Court by Writ of Summons. Alternatively if a debt exceeds the sum of £750 Bankruptcy Proceedings can be commenced by way of Statutory Demand for bankruptcy or for the winding up of a limited company where either a judgement has been obtained or the debt is not disputed.

We acknowledge that the majority of UK Private Sector jobs are created directly by small and medium business enterprises. They are vital to the Northern Irish Economy. Cash flow is one of the single greatest problems that affects these businesses. Late payment of debts can be a serious problem for these businesses. Under the Late Payment of Commercial Debts Interest Act 1998 and The Late Payment of Commercial Debts Regulations 2002 provision has been made for a compensatory award, which is payable per late paid invoice. The compensation entitlement ranges from £40.00 to £100.00 per late paid invoice. We provide help and assistance in calculating whether you may be eligible under this legislation for the compensatory award.

Edmund, educated at University of Ulster, specialises in Lender Services, Insolvency and Business Restructuring. He currently manages a top 5 UK Bank mortgage litigation contract and has extensive experience of asset and debt recovery.

He conducts the day to day operations of a large mortgage litigation team and has carried this out for 20 years, ensuring that the firm adheres to stringent service level agreements. Edmund has developed a team within lender services to proactively address rehabilitation issues in order to maintain the position of the lender within a difficult property market. He has extensive experience in all areas of recoveries including asset recovery, shortfall recovery and bankruptcy and his clients include lenders and large corporations.

Rosaleen graduated from The University of Ulster in 2011, with an LLB (Hons) degree in Law.

After graduating, she worked as a Legal Costing Executive for two years, providing advice and assistance to the legal profession on technical cost issues relating to both County Court and High Court actions. Rosaleen gained experience and knowledge of case law and legislation in the area of costs and assisted solicitors by drafting formal written advices, estimates of costs, negotiated legal costs and provided representation at detailed assessment hearings before the Taxing Master.

Rosaleen later joined a large Human Rights Law firm in Belfast and worked predominately within the litigation department for one year before commencing her Apprenticeship in September 2014. As a Legal Executive and Apprentice, Rosaleen specialised in actions against the state and other public bodies in relation to harassment, misfeasance within the public office, negligence, personal injury, human right violations and abuses of state power, playing an active role in several landmark cases. Rosaleen gained extensive experience in other areas such as road traffic accidents, medical negligence, employers liability and commercial contracts.

Rosaleen joined R G Sinclair & Co in November 2016 and she is a Solicitor within the Debt and Insolvency Department working closely with our Director, Mr Edmund Sinclair. Rosaleen assists in all areas of recoveries to include, asset recovery, shortfall recovery and bankruptcy on behalf of creditors. She also assists borrowers on refinancing, restructuring, secured and unsecured lending, acquisition finance, loan portfolio sales and commercial finance.  Rosaleen manages a heavy case load for clients who are individuals, sole traders, lenders and large corporations. In addition to this, Rosaleen also assists within our Litigation Department in areas of professional negligence, commercial litigation, high value personal injury litigation and banking litigation.

Outside of work Rosaleen has run charity events for Cancer Research and raised substantial sums for charity. Rosaleen has been actively involved in her local community in recent years as both chairperson and youth leader of CYC, with the aim of empowering individuals to develop and enjoy new challenges through volunteering and social action while making a positive contribution to the community.
