The Role Of The Conveyancing Solicitor.

It is well known that buying or selling your home is perhaps one of the most stressful tasks to undertake, whilst also being one of the most expensive. The process itself involves various stakeholders, including Solicitors, Mortgage Brokers and Estate Agents, who all play important roles.

It’s perhaps easier to appreciate the work being done by a mortgage broker or estate agent, given that the complex work undertaken by a Conveyancing Solicitor is largely ‘behind the scenes’ and as such is often not understood.

The work involved in a conveyancing transaction is extensive. We outline in short article some of the main tasks undertaken:

Buying Your Home


Perhaps one of the most crucial responsibilities of a conveyancing Solicitor is to review the title to the property you propose to purchase. The process of reviewing title which is time consuming and extremely detailed requires the expertise of a trained, skilled, conveyancing solicitor with the relevant knowledge and experience.

Reviewing searches and Property Certificates and ensuring that the necessary easements and rights of way are in place.

Making sure that the relevant Planning Permission and Building Control Approvals are in place.

Reviewing the mortgage offer and valuation report and ensuring that any issues raised by the valuer are addressed.

Providing detailed advice to you regarding the title to the property and ensuring that you are fully aware of your obligations under the terms of the title and the contract.

Drafting the transfer deed that will ensure that ownership passes from the vendor to you on completion.

Dealing with the negotiation of any special conditions that may be required in relation to the contract.

Scheduling completion and dealing with the purchase funds.

Following completion your Solicitor will also deal with the Stamp Duty Land Tax return and payment that will be due to HMRC (if applicable).

Selling Your Home

  • Procuring documents of title and preparing the contract to send to the purchaser’s Solicitor.
  • Requisitioning the relevant Property Certificates and Searches.
  • Responding to any title queries raised by the purchaser’s Solicitor.
  • Dealing with the execution of the contract and Deed of Transfer, dealing with completion funds, and the release of any mortgage.

Nikki Bell obtained her Law Degree at the University of Ulster and went on to undertake a Masters Degree in Human Rights Law at Queens University Belfast.

Nikki joined the firm in July 2011 as a paralegal and subsequently obtained an Apprenticeship with the firm to complete her Solicitor training at the Institute of Professional Legal Studies. Nikki is now Head of the Residential Conveyancing Department specialising in all property matters to include residential sales and purchases as well as acting for developers. Nikki also acts for a number of major lender clients in relation to post possession sales.

David McCormick graduated from Queens University Belfast in law in 1987, attended the Institute of Professional Legal Studies, and qualified as a solicitor in 1989.

He has vast experience and knowledge in a variety of mainly non-contentious work, with a strong background in land and property matters, and joined the firm in June 2012.

David works primarily in the Private Client Team, dealing with residential and commercial property and asset protection. He also assists the teams dealing with repossession sales and remortgage transactions.

Trainee Solicitor

Louise obtained her law degree from Queen’s University Belfast and went on to undertake a Master’s Degree in Criminal Justice and Criminology also from Queen’s.
Louise then joined Robert G Sinclair’s in March 2017 as a paralegal and have recently commenced my apprenticeship as a Trainee Solicitor in September 2018.
In her role as a paralegal Louise was able to gain experience in different departments within the firm including remortgaging and post-completion.
Louise has been a key member of the Conveyancing team for over a year now. In this role she has managed an extensive case load which involves working with large lender clients as well as with private clients.

Zita Duffy

Legal Executive

Zita studied at Lancaster University where she obtained an undergraduate degree in Criminology, and graduated with a Bachelor of Arts with Honours. Zita is a member of the Chartered Institute of Legal Executives and holds the Level 3 Certificate in Conveyancing.
Zita joined the firm in October 2018 and has been proficient when dealing with large caseloads, becoming a key member of the Conveyancing Team. She has significant new-build development experience working both with developers in sales and with private clients in new-build purchases. Outside of work she enjoys supporting Ulster Rugby and spending time with her nieces.
